Is a certification necessary when providing a value analysis letter for litigation exposure?
The client has asked us to write a memo analyzing the possible value(s) of a business from what we believe are reasonable assumptions and the possible arguments and conclusions an opposing party might asert based on different assumptions and methodology. The purpose of the memo is to evaluate the client's exposure in a litigation setting. Does this memo constitute a valuation report and/or require an appraiser certification? We clearly state that this is a preliminary analysis, we have not completed our field work, the information we are relying on, the procedures that have been completed thus far, that the purpose of the memo is for management to evaluate their position for settlement purposes.
